Koh Phi Phi Island port transfert is public or commercial ?

The transfer mission wavers for the administrative organization of the Ao Nang sub-district. It finds itself trapped by the authorities. Only one question arises? The Department of Marine and the Department of Treasury of Krabi Province had come to hold a public hearing to improve the pier and measure the size of the bridge in order to make changes before auctioning the commercial pier to the private sector.

“At this stage, the president believes that this matter cannot be decided. As the information is still unclear, I would like to assign ownership of the story to the provincial decentralization subcommittee (Krabi province). This sub-committee was formed by the Department of Marine, National Parks, Wildlife, Treasury and the representatives of the people who complained formed this sub-committee to discuss and advise.

The conflict in this situation is between being “public moorings” and “commercial moorings” and who has authority over them. The action plan indicates that the berths to be transferred to the local authority are not specified, and in the past the Treasury Department and the Navy Department have advised that ownership of berths is a property right.

In accordance with the decentralization plan that specifies that any mission to be transferred to the Local Authority, this mission must be in perfect condition, in order to be eligible for transfer, but currently, the port is in a very dilapidated state. In order to improve it, it would need 2 million baht. The Ao Nang Sub-District Administrative Organization stated that while it is clearly stated that the Sub-District Administrative Organization is responsible for the operation of the port, the Ao Nang Sub-District Administrative Organization has prepared a budget to improve the port.

While the “Treasury Department” is willing to transfer the port to the Sub-district Administrative Organization, the Ratchaphatsadu Law imposes conditions in the case of public use. However, it can be given to government agencies for commercial purposes. The work should be done accordingly. The Ratchaphatsadu Benefit Act must be turned over to the Ministry of Finance as the owner, while the Mars Department insists that the use of the Phi Phi Island Pier is a commercial use.

In the case of a public pier under local jurisdiction, an application can be made to the Treasury Department, but the ownership rights still belong to the Ministry of Finance. If it is a commercial wharf, it must be operated in accordance with the Royal Property Act and other regulations. The acquisition of the benefits of the royal property must be done through leasing.

In the past, in 2009, the province agreed to allow the administrative organization of Ao Nang sub-district to lease the area and has already informed the conditions by calculating the rate of return of 50 percent of the revenue collected from the year B.E. 2009 to date, no payment has been made and no lease condition has been accepted.

The subcommittee agreed that it should be owned by the Treasury Department. But the Treasury Department representative explained that it is not owned by the Treasury Department, but by the Department of National Parks, Wildlife and Plants. If an agency owns it, it must be transferred to the local authority

Formerly built as a commercial wharf it is now being transformed into a public wharf. The Department of the Navy should consider revisiting the goals that were requested for a commercial or public construction budget.
